Refund policy

1. Scope
These refund policies apply to all contracts between Lucke IT Solutions (hereinafter the “Provider”) and its customers regarding the sale, provision, or implementation of AI systems, software solutions, and services.
The offer is directed exclusively at businesses (B2B).

 

2. No Right of Withdrawal in B2B
As the offer is directed exclusively at entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), there is no statutory right of withdrawal.

 

3. Customized AI Systems & Project Services
For customized AI systems, individual developments, configurations, or project-related services, refunds are excluded once:

• development has commenced, or

• the service has been partially or fully rendered.

Services already rendered will be charged on a pro rata basis.

 

4. Hosting & Software Solutions
For hosting, SaaS, or software solutions, the following applies:

• Fees already paid for ongoing or commenced billing periods are non-refundable.

• Termination takes effect only at the end of the agreed billing period, unless otherwise agreed.

5. On-Premise Solutions
For on-premise installations, refunds are excluded once:

• the software has been delivered or installed, or

• the customer has been granted access to the source code or software.

6. Exception: Technical Non-Performance
If an agreed service is demonstrably not provided and the Provider is responsible for this, a pro rata refund may be granted in individual cases.
No further claims exist.

 

7. Subscription & Maintenance Agreements
Subscriptions, maintenance, or support agreements may be terminated in accordance with the contractually agreed notice periods.
Refunds of amounts already paid are excluded.

9. Final Provisions
The law of the Federal Republic of Germany applies.
Place of jurisdiction is—where permissible—the Provider’s registered office.
