Service provision
1. Type of Service Provision
The services offered by Lucke IT Solutions are provided exclusively in digital form or through technical setup. No physical goods are shipped.
Depending on the agreed scope of services, provision takes place in one or more of the following forms:

Access to cloud-based AI systems (hosting/SaaS)

Digital delivery of software, license keys, or access credentials

Installation and setup of AI systems for on-premise operation
-
Provision of project services, configurations, or custom adaptations
2. Time of Provision
Unless otherwise agreed, services are provided:
-
after conclusion of the contract, and
-
after receipt of payment, and
-
after all information required for implementation has been provided by the customer.
Timeframes for service provision are non-binding unless expressly agreed as binding.
3. Customer Cooperation Obligations
The customer is obliged to create all prerequisites necessary for service provision in a timely manner. This includes in particular:
-
provision of technical access
-
transmission of relevant data and information
-
ensuring suitable IT infrastructure for on-premise solutions
Delays due to missing or late cooperation by the customer shall not be to the detriment of the provider.
4. Hosting & Cloud Services
For hosting or SaaS services, the provider grants the customer the agreed access to the AI solution via a cloud infrastructure.
Maintenance windows, updates, or security-related adjustments may be required and will be announced in advance where possible.
5. On-Premise Services
For on-premise solutions, the software is installed and handed over within the customer’s IT environment.
After successful handover, operation and responsibility for the system environment transfer to the customer, unless a separate maintenance agreement exists.
6. Acceptance
If acceptance is agreed, the service shall be deemed accepted if:

the customer uses the service productively, or
-
no material defects are reported within 14 days after provision.
7. No Shipment of Physical Goods
The services offered do not constitute physical products. No shipping, delivery, or transport costs apply.
8. Final Provisions
The law of the Federal Republic of Germany applies.
Place of jurisdiction is – where legally permissible – the provider’s registered office.
